OPSTI USLOVI POSLOVANJA

UVODNE ODREDBE

1.Zakupodavac – „ALEKSANDR TOROPIN PR FREEDOM BIKE RENTAL“ sa sedištem na adresi 11073 Ulica Jurija Gagarina br. 231, local br.344, matični broj: 67662385, PIB: 114544623
2.Zakupac – fizičko ili pravno lice koje zakupljuje ili u čije ime se vozilo zakupljuje.
3.Ugovor – pojedinačni ugovor o zakupu koji se potpisuje prilikom preuzimanja vozila u zakup u kome se odobrava korišćenje vozila, tačno određuje preuzimanje i vraćanje vozila, pokriće, dodatna oprema i usluge uključene u cenu zakupa, kao i način plaćanja cene, visinu depozita i ostala prava i obaveze koje obe ugovorne strane svojim potpisom u potpunosti prihvataju.
4.Zapisnik o predaji i stanju vozila – dokument koji Zakupodavac i Zakupac potpisuju prilikom preuzimanja vozila, a koji sadrži informacije o procenjenoj vrednosti vozila, stanju kilometraže, količini goriva, oštećenjima i eventualnim nedostacima na iznajmljenom vozilu i dodatnoj opremi.
5.Vozač – Fizičko lice koje potpisuje Ugovor i preuzima vozilo i koje je odgovorno za poštovanje svih odredaba Ugovora. Vozač mora posedovati odgovarajuću vozačku dozvolu određeni vremenski period i imati minimalan broj godina kao što sledi:
Za vozačku dozvolu AM, A1 i A2 kategorije, vozač mora imati navršenih 21 godinu i posedovati vozačku dozvolu minimum 2 godine.
Za vozačku dozvolu A kategorije, Vozač mora posedovati važeću vozačku dozvolu sa punom A kategorijom, odnosno kategorijom koja mu daje pravo da upravlja konkretnim vozilom koje je predmet Ugovora.
Vozačka dozvola mora biti važeća i mora davati pravo Vozaču da upravlja vozilom koje je predmet Ugovora. Ukoliko je vozačka dozvola izdata u inostranstvu, Vozač je dužan da, pre preuzimanja vozila, samostalno proveri da li se njegova vozačka dozvola priznaje za upravljanje vozilom na teritoriji Republike Srbije i da li je, u skladu sa važećim propisima Republike Srbije, pored strane vozačke dozvole dužan da poseduje i međunarodnu vozačku dozvolu ili drugi odgovarajući dokument. Vozač je dužan da prilikom preuzimanja vozila poseduje svu dokumentaciju potrebnu za zakonito upravljanje vozilom na teritoriji Republike Srbije.
Prilikom preuzimanja vozila, Vozač mora da poseduje opremu u skladu sa propisima Republike Srbije.
Opšti uslovi zakupa i Zapisnik o predaji i stanju vozila su sastavni delovi Ugovora o zakupu.

USLOVI ZAKUPA I NAČIN PLAĆANJA

Zakupac potpisom Ugovora potvrđuje da preuzima vozilo sa pripadajućom opremom i dokumentacijom, kao i ugovorenu dodatnu opremu u ispravnom stanju konstatovanom u Zapisniku o predaji i stanju vozila.
Vozač koji u ime Zakupca koji je pravno lice, preuzima vozilo i potpisuje Ugovor, mora da ima ovlašćenje Zakupca i odgovoran je Zakupodavcu solidarno sa tim pravnim licem za poštovanje i ispunjenje svih obaveza iz Ugovora.
Zakupnina se plaća prilikom preuzimanja predmeta ugovora i to gotovinom ili uplatom na račun.

Depozit za vreme trajanja zakupa je obavezan i plaća se u gotovini. U slučaju štete, depozit se zadržava do dobijanja zvaničnog izveštaja osiguravajuće kuće. U slučaju nevraćanja punog rezervoara sa gorivom, parking kazne ili u slučaju vraćanja veoma prljavog vozila, za štetu koja nije pokrivena osiguranjem, kao i za štetu nastalu na dodatnoj opremi koja nije osigurana, iznos za troškove se odbija od predatog depozita.

Potpisivanjem Ugovora Zakupac prihvata krivičnu, prekršajnu i materijalnu odgovornost u vezi sa korišćenjem predmeta Ugovora, za vreme perioda zakupa.
Minimalni period zakupa je jedan dan.
Ugovorena cena obuhvata pređenih 250 kilometara po danu zakupa. Ukoliko Zakupac ostvari veću kilometražu od ugovorene, obavezuje se da plati 0,40 evra po pređenom kilometru prekoračenja.

REZERVACIJA ZAKUPA
Zakupac može rezervisati zakup određenog vozila u dogovoru sa Zakupodavcem uz uplatu depozita za rezervaciju u iznosu od 30% ugovorene zakupnine.
Depozit za rezervaciju uplaćen radi potvrde rezervacije je nepovratan i ne refundira se u slučaju otkazivanja rezervacije od strane Zakupca, bez obzira na vreme otkazivanja, kao ni u slučaju da se Zakupac ne pojavi radi preuzimanja vozila u ugovoreno vreme.


OBAVEZE ZAKUPCA

-da će vozilo, po isteku zakupa vratiti na mesto i u roku utvrđenim Ugovorom, u stanju kojem ga je preuzeo u skladu sa Zapisnikom o predaji i stanju vozila
-Za produženje ugovorenog perioda zakupa, Zakupac mora tražiti saglasnost Zakupodavca putem elektronske pošte, 48 časova pre isteka zakupa.
-da vozilo neće preopteretiti, koristiti za obuku vozača, prevoz ili vuču drugih vozila, za plaćeni prevoz putnika, za trke, ispitivanja izdržljivosti i brzine i za nezakonite radnje
-da neće preopteretiti kasete na vozilu, tako što će u njih stavljati predmete ukupne mase veće od 7kg ili zapremine veće od 20l ili koristiti improvizovane trake i kaiševe za obezbeđenje istih. Preopterećenje kaseta može izazvati probleme u upravljanju vozila zbog promene u distribuciji mase i aerodinamike.
-da će vozilo koristiti samo Vozač, za sopstvene potrebe u skladu sa namenom vozila i da vozilo neće davati na korišćenje neovlašćenim licima. Omogućavanje neovlašćenom licu da koristi predmet ugovora od strane Zakupca se smatra kršenjem Ugovora i pored odgovornosti za sve posledice i štetu koja može nastati, Zakupac duguje i ugovornu kaznu u iznosu od 1000 evra, nezavisno od nastanka eventualne štete.
-da će vozilo koristiti pravilno i postupati prema vozilu sa pažnjom dobrog domaćina
-da će vozilo, prilikom napuštanja uvek zaključavati i obezbeđivati, a dokumentaciju i ključeve uvek imati pod ličnom kontrolom
-da će vozilo koristiti isključivo na javnim putevima, poštujući sve saobraćajne propise i regulaciju saobraćaja
-da će, u toku trajanja zakupa, brinuti o redovnoj tehničkoj ispravnosti vozila tako što će redovno proveravati nivo ulja i ostalih tečnosti, pritisak u gumama i slično
-da će, ukoliko smatra da je vozilu potreban servis ili kada na to ukazuju signalni instrumenti vozila, bez odlaganja da se javi Zakupodavcu radi upućivanja vozila u ovlašćeni servis i obavljanja servisnih aktivnosti i drugih popravki. Zakupac ne sme na vozilu i dodatnoj opremi vršiti nikakve popravke, promene delova, sklopova ili uređaja, bez saglasnosti Zakupodavca. U protivnom odgovara za svu nastalu štetu i eventualnu izgubljenu zaradu zbog nemogućnosti obavljanja osnovne delatnosti pojedinim vozilom, a dužan je Zakupodavcu isplatiti i ugovornu kaznu u vrednosti popravljenog ili zamenjenog dela, sklopa ili uređaja.
-da vozilo neće voziti izvan granica Republike Srbije, osim uz prethodnu pisanu saglasnost Zakupodavca dobijenu putem elektronske pošte.
-da će snositi sve troškove u vezi pogona vozila, gorivo, putarine, mostarine, parking, prekršajne i druge slične naknade
-da će u slučaju vremenske nepogode učiniti sve neophodne radnje da vozilo zaštiti

NASTANAK ŠTETE

U slučaju oštećenja vozila, manjka opreme ili pribora, nedostajuće dokumentacije, registarske oznake ili ključeva vozila, Zakupac je dužan da nadoknadi štetu. Za izgubljenu dokumentaciju, registarske oznake ili ključeve, Zakupac duguje ugovornu kaznu u iznosu od po 500 evra nezavisno od nastale štete.
U slučaju saobraćajne nesreće koja je nastala krivicom Vozaca, Zakupac je obavezan da nadoknadi Zakupodavcu svu nastalu štetu na vozilu, sve troškove nastale povodom saobraćajne nesreće, kao i iznos izgubljene dobiti u vidu dnevne zakupnine vozila do 30 dana.
Zakupac je odgovoran ako dođe do oštećenja motora ili pogonskog mehanizma vozila, kao i u slučajevima oštećenja kvačila, oštećenja kartera i slično, gubitka ili oštećenja dokumenata, ključeva, registarskih tablica, oštećenja sedišta ili dodatne opreme, točenja neodgovarajuće vrste goriva ili drugih kvarova izazvanih nemarnošću Zakupca ili Vozača (nepažljiva vožnja ili vožnja izvan asfaltnih puteva). Zakupac je odgovoran i za prekomerno oštećenje guma koje je evidentno nastalo neadekvatnom vožnjom, a utvrđuje se tako što je šara na gumi umanjena za 1 mm u odnosu na stanje konstatovano u Zapisniku o predaji i stanju vozila.
U svim navedenim slučajevima, Zakupac je dužan da nadoknadi Zakupodavcu celokupni iznos popravke vozila i zamene oštećene opreme i delova, kao i iznos izgubljene dobiti u vidu dnevne zakupnine vozila, ali ne više od 30 dana i svu ostalu nastalu štetu (troškove šlepa, umanjena vrednost vozila i dr.)

U slučaju saobraćajne nesreće, oštećenja, havarije, krađe, pogonske neispravnosti vozila i drugih sličnih okolnosti, Zakupac je obavezan:
-da čuva i obezbedi vozilo od propadanja i nastajanja još veće štete, do njegovog preuzimanja od strane Zakupodavca
-da zabeleži imena i adrese učesnika u saobraćajnoj nesreći
-da pozove policiju i pribavi policijski zapisnik, osim u slučaju pogonske neispravnosti vozila
-da bez odlaganja obavesti o događaju Zakupodavca
U slučaju da zakupac ne obezbedi policijski zapisnik sav trošak naknade štete u vezi sa oštećenjem ili nestankom vozila pada na teret Zakupca u punom iznosu, uključujući i izgubljenu dobit u visini dnevnog zakupa zbog nekorišćenja vozila, najviše do 30 dana, bez obzira na krivicu zakupca za događaj.

Zakupodavac ne odgovara za štetu koju pretrpi Zakupac zbog kašnjenja u isporuci vozila, kao i za štete koje bi nastale Zakupcu zbog kvara na vozilu za vreme najma.
Zakupodavac ne odgovara za štetu nastalu na predmetima koju Zakupac prevozi ili drži u kasetama koje se nalaze na vozilu za vreme trajanja zakupa.
Zakupodavac ima pravo da raskine Ugovor i odmah preuzme vozilo u posed, ako Zakupac ne postupi ili ne postupa u skladu sa bilo kojom odredbom ovih uslova ili Ugovora ili ako je vozilo oštećeno.

TROŠKOVI KOJI SE NADOKNAĐUJU ZAKUPCU

Zakupodavac će nadoknaditi Zakupcu neophodne troškove za ulje, druge tečnosti, redovno servisiranje i druge neophodne lake popravke, a koji su nastali tokom trajanja zakupa, osim troškova pranja vozila, a na osnovu priloženog računa po obavljenom plaćanju.
Za nadoknadu navedenih troškova, Zakupac mora prethodno pribaviti saglasnost Zakupodavca.
Zakupac je dužan da Zakupodavcu preda račun koji je izdalo pravno lice koje je izvršilo uslugu.

PRIKUPLJANJE I OBRADA LIČNIH PODATAKA

Zakupac lične podatke daje dobrovoljno. Obrada ličnih podataka Zakupca je nephodna za izvršenje Ugovora ili za preduzimanje radnji, na zahtev Zakupca, pre zaključenja Ugovora.
Zakupodavac će koristiti i obrađivati lične podatke u skladu sa Zakonom o zaštiti podataka o ličnosti i ostalim propisima Republike Srbije.

GENERAL TERMS AND CONDITIONS OF BUSINESS
INTRODUCTORY PROVISIONS
1. Lessor – “ALEKSANDR TOROPIN PR FREEDOM BIKE RENTAL”, with its registered address at 11073 Ulica Jurija Gagarina No. 231, local No. 344, registration number: 67662385, PIB: 114544623.
2. Lessee – a natural or legal person who rents the vehicle or on whose behalf the vehicle is rented.
3. Agreement – an individual rental agreement signed upon taking the vehicle into rental, which authorizes the use of the vehicle, precisely determines the handover and return of the vehicle, coverage, additional equipment and services included in the rental price, as well as the method of payment of the rental price, the amount of the deposit and other rights and obligations which both contracting parties fully accept by signing.
4. Vehicle Handover and Condition Report – a document signed by the Lessor and the Lessee upon taking over the vehicle, containing information on the estimated value of the vehicle, mileage, amount of fuel, damage and any defects on the rented vehicle and additional equipment.
5. Driver – a natural person who signs the Agreement and takes over the vehicle and who is responsible for compliance with all provisions of the Agreement. The Driver must possess an appropriate driving licence for a certain period of time and meet the minimum age requirements as follows:
For AM, A1 and A2 driving licence categories, the Driver must be at least 21 years old and have held a driving licence for a minimum of 2 years.
For an A category driving licence, the Driver must possess a valid driving licence with a full A category, or a category which gives him/her the right to operate the specific vehicle that is the subject of the Agreement.
The driving licence must be valid and must give the Driver the right to operate the vehicle that is the subject of the Agreement. If the driving licence was issued in a foreign country, the Driver is obliged, before taking over the vehicle, to independently verify whether his/her driving licence is recognized for driving a vehicle in the territory of the Republic of Serbia and whether, in accordance with the applicable regulations of the Republic of Serbia, in addition to the foreign driving licence, he/she is required to possess an international driving permit or another appropriate document. The Driver is obliged to possess, upon taking over the vehicle, all documentation necessary for the lawful operation of the vehicle in the territory of the Republic of Serbia.
Upon taking over the vehicle, the Driver must possess equipment in accordance with the regulations of the Republic of Serbia.
The General Rental Terms and Conditions and the Vehicle Handover and Condition Report are integral parts of the Rental Agreement.
RENTAL CONDITIONS AND METHOD OF PAYMENT
By signing the Agreement, the Lessee confirms that he/she takes over the vehicle with its accompanying equipment and documentation, as well as the agreed additional equipment, in the proper condition recorded in the Vehicle Handover and Condition Report.
The Driver who, on behalf of the Lessee that is a legal entity, takes over the vehicle and signs the Agreement must have authorization from the Lessee and is jointly and severally liable to the Lessor together with that legal entity for compliance with and fulfillment of all obligations under the Agreement.
The rental fee is paid upon taking over the subject of the Agreement, either in cash or by payment to the bank account.
The deposit for the duration of the rental is mandatory and is paid in cash. In the event of damage, the deposit is retained until the official report of the insurance company is received. In the event that the vehicle is returned without a full fuel tank, in the case of parking fines or in the event that the vehicle is returned very dirty, for damage that is not covered by insurance, as well as for damage to additional equipment that is not insured, the amount of the costs is deducted from the deposited amount.
By signing the Agreement, the Lessee accepts criminal, misdemeanor and material liability in connection with the use of the subject of the Agreement during the rental period.
The minimum rental period is one day.
The agreed price includes 250 kilometres driven per rental day. If the Lessee exceeds the agreed mileage, he/she is obliged to pay EUR 0.40 for each kilometre exceeding the agreed mileage.
RENTAL RESERVATION
The Lessee may reserve the rental of a specific vehicle by agreement with the Lessor upon payment of a reservation deposit in the amount of 30% of the agreed rental fee.
The reservation deposit paid for the purpose of confirming the reservation is non-refundable and shall not be refunded in the event of cancellation of the reservation by the Lessee, regardless of the time of cancellation, nor in the event that the Lessee fails to appear to take over the vehicle at the agreed time.
LESSEE’S OBLIGATIONS

• to return the vehicle, upon expiry of the rental, to the place and within the period determined by the Agreement, in the condition in which he/she received it, in accordance with the Vehicle Handover and Condition Report;
• for an extension of the agreed rental period, the Lessee must request the consent of the Lessor by e-mail 48 hours before the expiry of the rental;
• not to overload the vehicle, use it for driver training, transport or towing of other vehicles, paid passenger transport, racing, endurance and speed testing, or illegal activities;
• not to overload the storage compartments on the vehicle by placing items in them with a total weight exceeding 7 kg or a volume exceeding 20 l, or use improvised straps and belts for securing them. Overloading the storage compartments may cause problems with vehicle handling due to a change in weight distribution and aerodynamics;
• to use the vehicle only by the Driver, for his/her own needs and in accordance with the intended purpose of the vehicle, and not to give the vehicle for use to unauthorized persons. Allowing an unauthorized person to use the subject of the Agreement by the Lessee shall be considered a breach of the Agreement and, in addition to liability for all consequences and damage that may arise, the Lessee shall owe a contractual penalty in the amount of EUR 1,000, regardless of whether any damage occurs;
• to use the vehicle properly and treat the vehicle with the care of a good householder;
• when leaving the vehicle, always lock and secure it, and always keep the documentation and keys under his/her personal control;
• to use the vehicle exclusively on public roads, complying with all traffic regulations and traffic control;
• during the rental period, take care of the regular technical condition of the vehicle by regularly checking the oil level and other fluids, tyre pressure and similar;
• if he/she considers that the vehicle requires servicing or when the vehicle’s warning instruments indicate this, immediately contact the Lessor in order for the vehicle to be directed to an authorized service centre and for servicing and other repairs to be carried out. The Lessee may not carry out any repairs, changes of parts, assemblies or devices on the vehicle or additional equipment without the consent of the Lessor. Otherwise, he/she shall be liable for all resulting damage and any lost profit due to the inability to perform the basic business activity with the particular vehicle, and shall also be obliged to pay the Lessor a contractual penalty in the amount of the value of the repaired or replaced part, assembly or device;
• not to drive the vehicle outside the borders of the Republic of Serbia, unless the Lessee has obtained the Lessor’s prior written consent via e-mail.
• to bear all costs related to the operation of the vehicle, fuel, tolls, bridge tolls, parking, traffic fines and other similar charges;
• in the event of adverse weather conditions, take all necessary actions to protect the vehicle.

OCCURRENCE OF DAMAGE
In the event of damage to the vehicle, shortage of equipment or accessories, missing documentation, registration plates or vehicle keys, the Lessee is obliged to compensate for the damage. For lost documentation, registration plates or keys, the Lessee owes a contractual penalty in the amount of EUR 500 for each item, regardless of the damage incurred.
In the event of a traffic accident caused by the fault of the Driver, the Lessee is obliged to compensate the Lessor for all damage incurred to the vehicle, all costs arising from the traffic accident, as well as the amount of lost profit in the form of the vehicle’s daily rental fee for up to 30 days.
The Lessee is liable if damage occurs to the engine or vehicle drive mechanism, as well as in cases of clutch damage, crankcase damage and similar, loss or damage of documents, keys, registration plates, damage to the seat or additional equipment, filling with an inappropriate type of fuel, or other failures caused by the negligence of the Lessee or Driver (careless driving or driving outside paved roads).
The Lessee is also liable for excessive tyre damage which is evidently caused by inadequate driving and is determined by the tread on the tyre being reduced by 1 mm compared to the condition recorded in the Vehicle Handover and Condition Report.
In all of the above cases, the Lessee is obliged to compensate the Lessor for the entire amount of the vehicle repair and replacement of damaged equipment and parts, as well as the amount of lost profit in the form of the vehicle’s daily rental fee, but not more than 30 days, and all other damage incurred (towing costs, reduction in the value of the vehicle, etc.).
In the event of a traffic accident, damage, major breakdown, theft, vehicle mechanical failure and other similar circumstances, the Lessee is obliged:

• to protect and secure the vehicle from deterioration and the occurrence of further damage until it is taken over by the Lessor;
• to record the names and addresses of the participants in the traffic accident;
• to call the police and obtain a police report, except in the event of vehicle mechanical failure;
• to notify the Lessor of the event without delay.

If the Lessee fails to obtain a police report, all costs of compensation for damage related to damage to or disappearance of the vehicle shall be borne by the Lessee in full, including lost profit in the amount of the daily rental fee due to the vehicle being unavailable for use, for a maximum of 30 days, regardless of the Lessee’s fault for the event.
The Lessor shall not be liable for damage suffered by the Lessee due to a delay in delivery of the vehicle, nor for damage that would arise to the Lessee due to a vehicle breakdown during the rental.
The Lessor shall not be liable for damage to items which the Lessee transports or keeps in the storage compartments located on the vehicle during the rental period.
The Lessor has the right to terminate the Agreement and immediately take possession of the vehicle if the Lessee fails to act or does not act in accordance with any provision of these terms and conditions or the Agreement, or if the vehicle is damaged.
COSTS REIMBURSED TO THE LESSEE
The Lessor shall reimburse the Lessee for necessary costs for oil, other fluids, regular servicing and other necessary minor repairs incurred during the rental period, except for vehicle washing costs, based on the submitted invoice after payment has been made.
For reimbursement of the above-mentioned costs, the Lessee must obtain the Lessor’s prior consent.
The Lessee is obliged to provide the Lessor with an invoice issued by the legal entity that performed the service.

COLLECTION AND PROCESSING OF PERSONAL DATA
The Lessee provides personal data voluntarily. The processing of the Lessee’s personal data is necessary for the performance of the Agreement or for taking actions at the request of the Lessee prior to the conclusion of the Agreement.
The Lessor shall use and process personal data in accordance with the Law on Personal Data Protection and other regulations of the Republic of Serbia.
